These Terms and Conditions (“Terms”) govern your use of South65TrashService.com and any trash-collection or related services provided by South 65 Trash Service, LLC, doing business as South 65 Trash Service (“South 65,” “we,” “us,” or “our”).
By using our website, requesting service, creating an account, making a payment, or using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website or our services.
1. Eligibility and Customer Information
You must be at least 18 years old and legally able to enter into an agreement to order services.
You agree to provide accurate and complete contact, billing, and service-location information. You must notify us promptly if this information changes.
You represent that you own the service property or are authorized by the property owner to arrange for trash-collection services at that location.
2. Service Area and Availability
Services are available only within locations served by South 65. Submission of a request or payment does not guarantee that we can provide service at a particular address.
We may accept, decline, suspend, or discontinue service when an address:
Falls outside our service area
Cannot be safely or legally accessed
Requires equipment or service we do not provide
Presents unreasonable health or safety risks
Has an unpaid or delinquent account
Otherwise cannot reasonably be serviced
We may change our service area, routes, collection days, or available services when reasonably necessary.
3. Collection Schedule
We will provide customers with an expected collection day. Collection times are estimates and are not guaranteed.
Customers must place accepted waste and containers at the designated collection location by 6 AM CT on the scheduled collection day. Containers should not be placed out earlier than permitted by applicable laws or neighborhood rules and should be removed from the roadside after collection.
Collection schedules may change because of holidays, severe weather, road conditions, mechanical problems, staffing limitations, governmental orders, landfill closures, emergencies, or other circumstances beyond our reasonable control.
When practical, we will communicate material schedule changes through our website, telephone, email, text message, social media, or another reasonable method.
4. Customer Responsibilities
Customers must:
Place waste in approved bags or containers
Keep containers reasonably clean and sanitary
Secure waste to prevent animals, wind, or weather from scattering it
Keep the collection area free from vehicles, gates, snow, ice, animals, low branches, and other obstructions
Provide safe and lawful access to the collection location
Follow applicable weight, volume, and container requirements
Comply with applicable federal, state, and local waste-disposal laws
Notify us of conditions that could create a safety risk
Drivers are not required to enter buildings, garages, fenced areas, or other private locations unless we have expressly agreed to provide that service.
South 65 may decline to collect waste that is improperly prepared, inaccessible, unsafe, excessive, or inconsistent with these Terms.
5. Acceptable Waste
Unless we agree otherwise in writing, regular service is limited to ordinary household waste that can lawfully be placed in a residential trash container and accepted by the disposal facility we use.
The following are not accepted through regular collection:
Hazardous, toxic, corrosive, reactive, explosive, or radioactive materials
Hot ashes, burning materials, fireworks, ammunition, or explosives
Gasoline, fuel, oil, propane tanks, or other flammable materials
Wet paint, pesticides, chemicals, solvents, or similar products
Lead-acid batteries
Whole tires
Major appliances
Medical waste, needles, or other sharps that are not lawfully and safely packaged
Sewage, liquid waste, or human or animal remains
Concrete, bricks, rocks, dirt, or large amounts of construction material
Large furniture or bulky items unless separately approved
Any item prohibited by law, a disposal facility, or South 65’s safety requirements
Missouri restricts or prohibits landfill disposal of certain items, including major appliances, whole tires, oil, and lead-acid batteries. Customers are responsible for determining whether an item may lawfully be placed in their household trash.
Contact us before placing an uncertain, oversized, unusually heavy, or potentially hazardous item out for collection. Additional services or charges may apply to approved special items.
6. Weight, Volume, and Additional Waste
Regular service includes one approved trash bin per week.
Containers must not exceed 150 pounds. Lids must be able to close unless we have approved additional waste.
We may leave behind overloaded containers, loose waste, or waste placed outside the approved container. Additional bags, bulky items, excessive volume, or special pickups may require advance approval and an additional charge.
The customer is responsible for reasonable cleanup, damage, injury, or additional expense caused by an overloaded container, leaking waste, prohibited material, or improperly prepared trash.
7. Containers
Any container provided by South 65 remains our property unless it was expressly sold to the customer. Customers may not sell, remove, alter, paint, damage, or allow another person to use a South 65 container at a different address.
Customers are responsible for reasonable care of company-owned containers and may be charged for loss or damage beyond ordinary wear, including damage caused by misuse, fire, prohibited materials, vehicles, animals, or unauthorized alterations.
South 65 is responsible for damage caused directly by our negligent handling of a company-owned container.
When service ends, customers must make company-owned containers available for retrieval. A replacement or non-return fee of $100 may apply if a container is lost, destroyed, withheld, or unavailable for retrieval.
8. Driveways and Private Property
If a customer asks or permits South 65 to enter a private driveway, road, or other area, the customer represents that the surface and surrounding area can safely support our vehicles and equipment.
Heavy collection vehicles may crack, sink into, mark, or otherwise affect asphalt, concrete, gravel, culverts, landscaping, or underground structures. To the extent permitted by law, South 65 is not responsible for damage resulting from ordinary vehicle weight or from concealed, weak, improperly maintained, or unsuitable surfaces.
We may refuse to enter any area our driver reasonably considers unsafe.
9. Missed or Incomplete Collections
A collection is not considered missed when:
Waste was not out by the required time
Waste or the container was inaccessible
The container was overloaded
Waste was improperly prepared
Prohibited materials were present
The account was delinquent or suspended
Road, weather, or safety conditions prevented collection
The customer failed to follow these Terms
If you believe we missed a properly prepared collection, contact us within seven business days. We will review the circumstances and, when appropriate, arrange another collection or provide an account credit. The available remedy will be determined reasonably based on route availability and the circumstances.
10. Prices, Billing, and Payment
Current prices will be provided when you request service. Unless otherwise stated, applicable taxes, government charges, special-item fees, overage fees, container fees, and other approved charges may be added.
Customers are billed monthly, in advance. Payment is due on or around the date of service sign up.
By providing a payment method, you represent that you are authorized to use it. If you enroll in automatic payments, you authorize South 65 and its payment processor to charge the payment method on file for recurring service charges and other authorized amounts until automatic payment or service is canceled.
You must notify us promptly of billing errors. A failed or returned payment may result in a fee of $25, to the extent permitted by law.
11. Price Changes
We may change service prices, fees, or billing practices. When required, we will provide advance notice by email, text message, bill insert, website posting, or another reasonable method.
Continued use of the services after a price change takes effect constitutes acceptance of the revised price. If you do not agree with a price change, you may cancel service in accordance with Section 13.
12. Past-Due Accounts
If payment is not received when due, we may:
Charge an authorized late or returned-payment fee
Suspend collection
Decline to remove accumulated waste
Retrieve company-owned containers
Cancel service
Refer the balance for collection
Recover reasonable collection expenses when permitted by law
Service suspension does not automatically cancel the account or eliminate amounts already owed.
A reactivation fee of $25 may apply before suspended service resumes. Waste accumulated during a suspension may require a separately priced pickup.
13. Service Term and Cancellation
Service continues until canceled by the customer or South 65 unless a specific service period has been agreed upon.
Customers may cancel by contacting us at 660-221-3843 at least one day before the next billing date. Unless required by law or stated otherwise, cancellation takes effect at the end of the current paid billing period.
Prepaid service charges are nonrefundable
South 65 may suspend or terminate service for nonpayment, unsafe conditions, prohibited waste, repeated violations of these Terms, abusive or threatening conduct, misuse of containers, or another legitimate business or safety reason.
Provisions that logically should continue after termination—including payment obligations, property rights, disclaimers, limitations of liability, indemnification, and dispute provisions—will remain effective.
14. Weather, Emergencies, and Events Beyond Our Control
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, flooding, snow or ice, fire, road closures, accidents, vehicle breakdowns, fuel shortages, labor shortages, landfill closures, governmental actions, public emergencies, or natural disasters.
A delayed collection may be completed on another day or combined with the next scheduled collection. Service credits or refunds are not automatically provided for delays outside our reasonable control.
15. Communications
By providing your contact information, you agree that we may contact you regarding inquiries, service, billing, collection schedules, account notices, emergencies, and other transactional matters.
If you consent to receive text messages, message and data rates may apply. You may opt out of nonessential texts by replying STOP. Reply HELP for assistance.
Consent to receive marketing messages is not required to purchase service.
16. Website Use
You may use our website only for lawful purposes. You may not:
Attempt to gain unauthorized access to the website or related systems
Interfere with the website’s operation or security
Introduce malware or harmful code
Submit false, fraudulent, or misleading information
Copy or commercially exploit website content without permission
Use automated systems to scrape or overload the website
Impersonate another person or misrepresent your authority
We may restrict website access when necessary to protect our systems, customers, or business.
17. Intellectual Property
The South 65 name, logo, website design, text, graphics, photographs, and other website materials are owned by or licensed to South 65 and are protected by applicable intellectual-property laws.
You may view and print website content for personal, noncommercial use. No other license or right is granted without our prior written permission.
18. Third-Party Services and Links
Our website may contain links to or use services operated by third parties, such as payment processors, mapping services, customer-management platforms, or social networks.
South 65 does not control and is not responsible for third-party websites, services, availability, security, content, or privacy practices. Your use of a third-party service may be governed by separate terms and policies.
19. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as available” basis.
South 65 does not guarantee uninterrupted website access, exact collection times, or that services will always be free from delays or errors. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
20. Limitation of Liability
To the fullest extent permitted by law, South 65 will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, loss of use, or damage caused by delayed or missed collection.
South 65’s total liability arising from a claim will not exceed the amount the customer paid South 65 for the affected service during the three months immediately preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
21. Customer Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold South 65 and its owners, employees, contractors, and agents harmless from claims, losses, damages, penalties, and reasonable expenses arising from:
Waste or materials you place for collection
Prohibited, dangerous, or improperly prepared materials
Inaccurate information you provide
Unsafe conditions on property you control
Your misuse of our website, services, or containers
Your violation of these Terms or applicable law
This section does not require you to indemnify South 65 for its own negligence or unlawful conduct.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Any legal action relating to these Terms or our services must be brought in a state or federal court having jurisdiction in Pettis County, Missouri, unless applicable law requires otherwise.
Before filing a lawsuit, the parties agree to make a good-faith effort to resolve the dispute by contacting one another and allowing at least 30 days for a response.
23. Changes to These Terms
We may revise these Terms periodically. Revised Terms will be posted on our website with an updated effective date.
When changes materially affect an existing customer’s service or payment obligations, we will provide reasonable notice when required. Continued use of the website or services after revised Terms take effect constitutes acceptance of those changes.
24. General Provisions
These Terms, the Privacy Policy, and any written service order or pricing agreement constitute the agreement between you and South 65 concerning the website and services.
If a provision is found unenforceable, the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver of that provision.
You may not transfer your account or rights under these Terms without our written permission. We may assign these Terms as part of a sale, restructuring, or transfer of our business.
If a written service agreement conflicts with these Terms, the written service agreement controls for the subject it specifically addresses.
